In HKSAR v Lee Kei Lok [2025] HKCFI 1808, HCMA 196/2024, Priscilia Lam and Ching Him Ho acted for the successful appellant who was convicted by a magistrate of 1 count of wounding contrary to section 19 of the Offences Against the Person Ordinance (Cap. 212).

 

The gist of the case concerned the necessity of giving a Liberato direction and whether the magistrate erred in her assessment of the evidence. Deputy High Court Judge Edmond Lee accepted both grounds of appeal and found that the possibility of PW1 hurting herself accidentally could not be ruled out. As a result, the appeal was allowed. The appellant’s conviction was quashed and the sentence was set aside without a re-trial.
