Priscilia Lam SC and Sean O’Reilly represented the Appellant in 香港特別行政區 對 羅偉文 [2026] HKCA 929

The Appellant was unanimously convicted after trial of one count of murder and sentenced to life imprisonment. The Appellant appealed against his conviction and the appeal was allowed. The case would be remitted for a re-trial.

The issue in the appeal was whether the trial Judge had erred in directing the jury in relation to the issue of provocation and diminished responsibility caused by the Appellant’s consumption of ice. The Court of Appeal ruled in favour of the Appellant’s submissions on points of law and found that the Judge’s summing up on diminished responsibility was inadequate.
