Priscilia Lam SC represented Chan Tsz-Wah ("Wayland") in HKSAR v Lai Chee Ying and Ors [2026] HKCFI 854 (the 1st Defendant in HCCC 147/2021) for mitigation. He pleaded guilty to one count of conspiracy to commit collusion with a foreign country or with external elements to endanger national security, contrary to Article 29(4) of the NSL and sections 159A and 159C of the Crimes Ordinance, Cap.200 (“Count 3”). 


The Court accepted Priscilia Lam SC’s submissions that different roles and acts of the co-conspirators should be taken into account in considering the appropriate starting point and the “banding issue”.


A starting point of 15 years’ imprisonment was adopted for Count 3, and the Court gave a discount of 8 years and 9 months to Wayland for all the mitigating factors. Wayland is sentenced to 6 years and 3 months’ imprisonment.
