Two of Tony Ko’s international investment dispute cases have been featured in the Department of Justice’s publication, “Hong Kong Professional Services Supporting Mainland Enterprises Going Global – Success Stories (Second Edition)”, under the legal services chapter. These cases are also published on the Hong Kong Professional Services GoGlobal Platform.
In Success Case 101, Tony acted as arbitrator in a dispute arising from a cross-border investment agreement involving RMB 500 million. The case concerned a Mainland Chinese enterprise acquiring a U.S.-operating business through a Hong Kong structure. The dispute was resolved through arbitration seated in Hong Kong, where asset preservation measures were successfully obtained, and the arbitral award was subsequently enforced in Chinese Mainland.
In Success Case 102, Tony acted for and advised a private equity fund with total investments of USD 700 million across Canada and Australia. The fund adopted a “Cayman-incorporated, Hong Kong-managed” structure, with state-owned enterprises as its principal investors. The investment dispute was effectively resolved through alternative dispute resolution proceedings conducted in Hong Kong.
The Hong Kong Professional Services GoGlobal Platform, initiated by the Department of Justice and supported by the Commerce and Economic Development Bureau in collaboration with the Hong Kong Trade Development Council, aims to build a comprehensive cross-sector professional services ecosystem. It integrates legal, financial, and accounting expertise to facilitate precise matching between Mainland enterprises and Hong Kong professionals, supporting businesses in expanding overseas in a secure and compliant manner.
These two cases highlight the international strengths of Hong Kong’s legal services and the GoGlobal Platform in structuring, risk management, and cross-border dispute resolution, echoing the “Go Global, Choose Hong Kong” initiative.
