Vinci Lam SC and Ching Him Ho secured acquittal for defendant in “doxxing” case

In HKSAR v Chan Chun Man ESCC 1465/2025, Vinci Lam SC and Ching Him Ho secured acquittal for the defendant who was charged with “disclosing personal data without consent” contrary to section 64(3C) of the Personal Data (Privacy) Ordinance (Cap 486), commonly known as “doxxing” offence.
The prosecution alleged that the defendant disclosed via a video uploaded on a website the personal data of X (X’s full name in Chinese and English, photo, HKID card number, Home Return Permit number, date and place of birth, residential address, telephone numbers, educational background and parents’ names) without X’s consent, while also displaying in the video X’s birth certificate and Chinese People’s Political Consultative Conference registration form, with the intent to or being reckless as to whether it would cause X or X’s family members specified harm.
After 4 days of trial, the court accepted the defence case put forward through cross-examination of X and defence evidence that the video in question was created for legitimate purposes and that the prosecution has failed to prove that the video was uploaded by the defendant or under his direction. The defendant was acquitted accordingly.
