15 August 2019 - In The Bar Council v Mark Richard Charlton Sutherland [2019] 4 HKLRD 294, [2020] 1 HKC 392 the Court of Appeal dismissed the barrister's application for stay of execution of the order of the Barristers Disciplinary Tribunal ("BDT") suspending him from practising as a barrister for a total of 36 months, and to pay the Bar Council costs on a full indemnity basis.  The Court of Appeal considered in detail (1) the BDT's jurisdiction to order a stay of execution and (2) the principles governing an application for stay of execution of an order of the BDT.  The judgment of the Court of Appeal can be found here.  Tony Ko appeared for the Bar Council.
